DIC GROUP AND NOVALAND PROJECT INSPECTIONS HAVE TO BE COMPLETED BEFORE APRIL 20TH

This is the request of Deputy Prime Minister Tran Hong Ha for the Prime Minister's working group on solving difficulties and obstacles in the implementation of real estate projects.

The Deputy Prime Minister requested to focus on completing the inspection work in the area with many recommendations of enterprises.

On April 16, the Government Office issued the conclusion of Deputy Prime Minister Tran Hong Ha at the meeting with the Prime Minister's working group on solving difficulties and obstacles in the implementation of real estate projects.

 

 

Determine the list of projects, objects, conditions and criteria for enjoying the credit package of VND 120,000 billion

The Deputy Prime Minister asked the working group to focus on completing the inspection work in Dong Nai and Binh Thuan provinces. the area has many recommendations of businesses such as Novaland, Dai Phuoc ecological urban area, Long Tan tourist urban area ... Completion is due by April 20.

On the basis of the results of reviewing and summarizing problems through reports of localities, inspection at projects, from recommendations of localities and enterprises sent directly to the working group, the Deputy Prime Minister assigned the Ministries: Construction, Natural Resources and Environment, Planning and Investment, Finance groups entanglements.

Specifically, the group of problems has been prescribed by law, but due to local implementation, the Deputy Prime Minister requested ministries to have specific instructions before April 25 for localities to implement.

With the group of problems caused by the provisions of the Circular, the Deputy Prime Minister requested the ministries to preside over and coordinate with the Ministry of Justice to amend and supplement according to the shortened order and procedures for promulgation in April 2023.

For problems caused by conflicts between regulations or regulations that are not yet specific or have not been guided in decrees, the Deputy Prime Minister shall request a report and propose the Government to amend and supplement in the form of a Decree amending and supplementing many Decrees in order, abbreviated procedure.

For the amended and supplemented contents in the Laws that are being submitted to the National Assembly for consideration such as the Law on Land (amended), the Law on Housing (amended), the Law on Real Estate Business (amended), the National Assembly is proposed to allow its implementation after 45 days from the date of approval by the National Assembly; problems that have not yet been amended immediately in the proposed Laws, the Government shall submit to the National Assembly for promulgation a resolution for resolution.

For practical issues proved to be necessary and appropriate but entangled by law or matters that have wronged the law but cannot be remedied, the Deputy Prime Minister shall request to summarize, report and propose competent authorities principles of settlement and non-legalization of violations.

The Deputy Prime Minister assigned the Ministry of Construction to assume the prime responsibility for determining the list of projects, objects, conditions and criteria for enjoying the credit program of about VND 120,000 billion under Resolution 33; At the same time, it serves as a basis for localities to identify and announce projects on social housing, workers' housing, projects on renovation and reconstruction of old apartments, ensuring publicity, transparency and compliance with regulations.

The Ministry of Construction is also tasked with developing criteria for assessing the classification of real estate segments based on potential (industry, tourism, commercial services), liquidity of the market as a basis for credit institutions to consider relaxing lending conditions without equating the policy with risky projects issued in April 2023.

The Deputy Prime Minister also requested the Ministry of Construction to assume the prime responsibility for, and coordinate with the Ministry of Planning and Investment in, guiding localities to remove difficulties in the application of the master plan when approving project investment policies.

With the State Bank, the Deputy Prime Minister requested the issuance of a circular stipulating the restructuring of debt repayment terms, criteria for assessing customer capacity in order to support customers to remove difficulties, contributing to the development of investment, production and business activities before April 25.

The State Bank is also required to direct commercial banks based on the list of projects, objects and conditions for beneficiaries of the credit program of about VND 120,000 billion of the Ministry of Construction under Resolution No. 33 to apply lending conditions and establish a risk provision fund, Do not equate between businesses.

The Deputy Prime Minister also requested the State Bank to strengthen inspection and urge credit institutions to implement solutions to support and promote the development of the real estate market.

With the Ministry of Natural Resources and Environment, the Deputy Prime Minister requested to review the problems of the circulars, urgently amend and issue according to the shortened order and procedures in April 2023; direct, urge and guide localities to remove difficulties and obstacles in determining land prices, formulating annual land use plannings and plans, especially at the district level; guide localities in handling small areas of interspersed public land that cannot be separated into independent projects.

The Deputy Prime Minister assigned the Ministry of Planning and Investment to assume the prime responsibility for, and coordinate with relevant ministries, sectors and agencies in, directing, urging and guiding localities to remove difficulties and obstacles in approving and adjusting investment policies for real estate projects, adjusting the project implementation schedule.

The Ministry of Planning and Investment shall assume the prime responsibility for, and coordinate with the Ministry of Finance, the Ministry of Natural Resources and Environment and relevant ministries, sectors and agencies in, guiding localities to remove difficulties and obstacles for real estate projects implemented under BT contracts before the time the Investment Law abolishes BT contracts.

The Ministry of Finance shall assume the prime responsibility for, and coordinate with concerned ministries, sectors and agencies in, directing, urging and guiding localities to remove difficulties and obstacles in conditions for maintaining the capital contribution rate not lower than 26% when relocating enterprises and production establishments; on whether a state-owned enterprise has changed land use purposes; plans for rearrangement and disposal of state-owned houses and land.

 

 

Working directly with each business and each project that has problems


In addition, coordinate with the Ministry of Planning and Investment to guide localities to remove difficulties and obstacles for real estate projects implemented in the form of BT contracts before the Law on Investment abolishes the form of BT contracts.

The Deputy Prime Minister requested the People's Committees of provinces and centrally-run cities to focus and drastically direct the implementation of problems implemented by the organization, under the competence of the provincial People's Committees such as public land issues interspersed in the project, determination of land prices, etc.

In case a land price consultant cannot be selected, the Deputy Prime Minister shall request the Department of Natural Resources and Environment, the Department of Finance and land price consultants to determine the land price in accordance with the provisions of law, and take responsibility to the Prime Minister if delay occurs, affecting state budget revenue, delaying the implementation of investment projects.

Localities are also required to actively work directly with each enterprise and each project with problems to clearly identify the causes in time to immediately remove difficulties and obstacles within their competence; summarize problems under the competence of the Prime Minister, the Government and the National Assembly, specifying the provisions of regulations and documents that are the causes of problems and send them to the working group before April 25.

The Deputy Prime Minister assigned the Ministry of Construction to assume the prime responsibility for, and coordinate with the Ministries: Natural Resources and Environment, Planning and Investment, Finance and the Government Office in, developing the Prime Minister's draft power on dismantling and promoting the safe development of the real estate market, healthy and sustainable, submitted to the Prime Minister by April 17.
