BA RIA - VUNG TAU STARTED PROVIDING "RED BOOKS" TO CONDOTEL

The People's Committee of Ba Ria – Vung Tau province assigns the Department of Natural Resources and Environment and related units to manage and guide the issuance of land use right certificates, construction works ownership rights… to tourist apartments, tourist villas according to regulations.

Implementing the guidance of the Ministry of Construction in accordance with Official Letter 276 / BXD-QLN dated January 20th 2020, the People's Committee of Ba Ria - Vung Tau Province has just issued a guiding document to strengthen management of investment, construction and business of tourist apartments, tourist villas in the province.

Accordingly, in order to well implement the management of investment, construction, business and operation of the type of tourist apartments in the province, the provincial People's Committee assigns the responsibilities of the relevant departments and agencies together with People's Committees of districts, towns, cities and investors of tourism real estate projects in the province enhance to perform some basic tasks.

For Departments of Natural Resources and Environment, this unit is responsible for presiding over and coordinating with relevant departments and agencies to manage and guide the issuance of certificates of land use right, ownership right of house and other properties associated with the land for the type of tourist apartments, tourist villas in accordance with the current regulations and at the same time continue to implement the instructions of the provincial People's Committee in Document No. 13116 / UBND- VP dated 24th December 2018.

For Department of Construction, the Provincial People's Committee requested this Department to coordinate with the relevant units to strictly implement the Prime Minister's directive on strengthening the renovation of construction planning, urban development management according to approved planning; Reviewing the proposal to convert tourist apartments, tourist villas into houses.

According to the direction, in the coming time, when advising the conversion of tourist apartments to houses, it is necessary to consider carefully and in accordance with current provisions of law on investment, law on urban planning, law on construction; ensure conformity with the approved construction planning, land use planning; housing development planning; suitable with the capacity to tolerate the population, the ability to meet the technical and social infrastructure of the region; comply with regulations, standards and construction standards.

At the same time, strengthening inspection, inspection, reviewing the adjustment of planning, conversion of functions, design of real estate projects in general, tourism apartment projects in particular, abnormal real estate business activities in which contrary to the law in real estate business in general and the type of tourist apartments in particular to prevent and handle in time violations of the law, require project investor to overcome violations (if any).

Department of Construction is responsible for leading and coordinating with the Department of Natural Resources and Environment, Department of Planning and Investment and relevant departments and agencies together with People's Committees of districts, towns and cities to perform investment and construction management of tourist apartment buildings, tourist villas, ensuring conformity with construction planning; approved land use planning, plan, tourism development plan.

In addition, the provincial People's Committee also assigned the Department of Information and Communications, the Department of Culture and Sports to strengthen the guidance of local media agencies to promote propaganda and dissemination of legal regulations on real estate trading and trading activities; advising organizations and individuals involved in real estate transactions or business to carefully research information, project legal documents and relevant law provisions. At the same time, inspect and handle the posting of information related to real estate trading and trading activities when the prescribed conditions are not met.

Earlier, at the beginning of February 2020, the Ministry of Natural Resources and Environment had sent documents to the Departments of Natural Resources and Environment of provinces and cities to guide the land use right certificates, construction works ownership rights for vacation hotel condos (condotel) project.

In particular, leaders of the Ministry of Natural Resources and Environment request provincial-level Departments of Natural Resources and Environment organize the review of approved investment projects and the implementation of land allocation and lease of each project to determine land use purposes and land use term according to the land law.

In case of being eligible for granting a certificate according to the provisions of land law and other relevant laws, the granting of a certificate to land use right, owners of properties associated with the land must be ensured legal rights and interests of land users and owners of properties associated with the land without changing the scale, objectives and planning of the project.
